COVID-19 ist eine “Seuche” iSd § 1104 ABGB. Somit war während der Lockdowns keine Miete zu bezahlen. Aber wie verhielt es sich in den Zeiträumen zwischen den Lockdowns? Hat der Mieter Anspruch auf Mietzinsreduktion? Und wenn ja, in welcher Höhe? Und wie verhält es sich bei Pachtverhältnissen?
Wie sieht es mit den im Frühjahr 2020 angepriesenen raschen Hilfen für Unternehmen durch den Staat aus? Eine eigene Gesellschaft, die COFAG, war für die Zuerkennung und Ausschüttung der unterschiedlichen Unterstützungsleistungen (Fixkostenzuschüsse, Verlustersatz, Ausfallsbonus, Lockdown-Umsatzersatz) zuständig. Teilweise sind diese noch nicht bei den Unternehmen angekommen, teilweise sehen sich Unternehmen mit Rückforderungsansprüchen der COFAG konfrontiert. Zu Recht?

Who pays the rent? Business premises rents during COVID and recovery claims from COFAG
COVID-19 is a “disease” within the meaning of § 1104 ABGB. So there was no rent to pay during the lockdown. But what about the periods between lockdowns? Is the tenant entitled to a rent reduction? And if so, how much? And what about leases?
What about the rapid state aid for companies announced in spring 2020? A separate company, COFAG, was responsible for awarding and distributing the various support services (fixed cost grants, loss compensation, loss bonus, lockdown revenue compensation).
Some of these have not yet reached the companies, some companies are confronted with reimbursement claims from COFAG. Right?
