Wolf Theiss assists Toms Group in Shaping Multi-Partner PPA in Poland’s Energy Market

Warsaw, 12 March 2024 – Toms Group, a leading player in the chocolate and confectionery industry, has formed a partnership with Enefit, a subsidiary of Eesti Energia Group, and Better Energy in Poland. Wolf Theiss acted as legal counsel to Toms Group in formulating one of Poland’s first multi-partner Power Purchase Agreement (PPA) models, which signals a pivotal development in the country’s energy market.

Within the framework of the tripartite agreement, Enefit, a participant in the Baltic energy sector, is set to provide Toms Group’s Polish production facilities with renewable energy sourced from Better Energy’s solar park in Chełmno, Poland. This includes providing additional energy volumes required for the operation of the Group’s production facilities in Nowa Sól and Leszno, marking a significant step toward sustainable energy solutions. Concurrently, Toms Group is investing in constructing its own 1 MWp energy source to meet the company’s energy needs in Poland. The PPA between Better Energy and Toms Group, announced in February 2023, designates Enefit to implement the physical PPA setup in 2024.

Partner Igor Muszyński provided legal counsel to Toms Group.
