Newssquare Drafts of the Personal Data Protection Act

Drafts of the new Polish Personal Data Protection Act ("PDPA Draft") and Provisions Implementing the Personal Data Protection Act (“Amending Act Draft”) were published on 14 September 2017. The Amending Act Draft amends 133 sectoral acts, in this client alert we describe changes to the Labour Law. The drafts are now subject to social consultations. The proposed regulations are to ensure the successful implementation of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 ("GDPR").

Newssquare Changes in Slovenian Labour Law

This year, changes to three Slovenian labour-law-related acts were proposed, aiming, inter alia, to reduce disguised employment (i.e. performance of services based on a civil law contract instead of entering into an employment relationship for which the basic elements of employment are provided). On the other hand, many initiatives are pointing out that several freelancers choose to work based on civil law contracts because of the nature of their work and a need to maintain flexibility on the market.

Newssquare The Debate on Contributions and Personal Income Tax is Now Opened

On October 4, 2017, The Federal Ministry of Finance in Federation of Bosnia and Herzegovina (FBiH) has announced the opening of the public debate on drafts of the Law on the Contributions and the Law on Personal Income Tax, adopted on the 21st session of the House of Peoples of the Parliament of Federation of Bosnia and Herzegovina held on September 21, 2017. The public debate is opened until January 1, 2018, which is also the deadline for delivery of comments and suggestions.

Newssquare Trade Mark Offensive 2017 - Amendments to the Austrian Trade Mark Protection Act

New regulations to the EU's Trade Mark Law were established with Regulation EU 2015/2424 of the European Parliament and of the Council and Directive EU 2015/2436 of the European Parliament and of the Council from 16.12.2015, which entered into force as of 1 October 2017. By implementing the Trade Mark Directive, the Austrian legislators have adapted the Austrian Trade Mark Protection Act (MSchG) to the European requirements within the amendment BGBl I Nr. 124/2017 from 1.8.2017 comprehensively. The amendment to the Trade Mark Protection Act has been in effect since 1 September 2017 for the most part and facilitates the application process in a number of ways.

Newssquare EU Court of Justice Rules on Intel Case – Exclusivity Rebates not Per Se Unlawful

On 6 September 2017, the Court of Justice of the European Union ("CJEU") delivered its long-awaited judgment in the Intel case. The CJEU quashed the 2014 judgment of the General Court ("GC") which had upheld a fine of EUR 1.06 billion imposed on Intel by the European Commission ("Commission") in 2009. Intel had been accused of abusing its dominant position by granting exclusivity rebates to customers.

Newssquare Amendments to EU Council Regulation on the EU Trade Mark Enter into Force on 1 October 2017

On 23 March 2016, new regulations to the EU's Trademark Directive entered into force with Directive EU 2015/2424 of the European Parliament and of the Council. Based upon secondary legislation, a number of further provisions will be effective as of 1 October 2017 and shall facilitate the application of trade marks in Europe.
