Dispute Resolution

Global financial uncertainty has brought with it a growing need for dispute resolution services across the region. In particular, if you're operating in a heavily regulated sector such as energy, financial services or healthcare, you know something about the potential risks that new regulatory burdens can bring as you work to protect your business. Unexpected questions may arise, such as "Should we initiate legal proceedings? Where and when? What legal tools and procedures are available to us? How do we stay one step ahead of competitors and adversaries? How do we avoid costly investigations so we can protect our reputation?" The Dispute Resolution team at Wolf Theiss specialises in helping you answer these questions so you can do what you do best: plan for the future.

Whether you represent a business or are an individual looking to protect your interests, you can turn to our experts if you're facing substantial losses or fear other consequences. We have a record of effectiveness in even the most sensitive and complex of civil claims, criminal actions and investigations. Our presence in 13 CEE/SEE countries means that the same goes for cross-border cases.

If you're facing a criminal investigation, or if you simply want to reduce your exposure to risk resulting from breach or non-compliance, we have the tools to help you. We offer customised compliance training programmes and assist you in discovering hidden risks so that you can plan accordingly. Also in our toolkit: global asset tracing. Very often investigations require conducting an asset trace to gather the necessary details to develop a profile and formulate a strategy. This is where our team helps clients to identify, trace, freeze and recover financial and physical assets in order to protect their business interests. Our regional contacts allow us to combine our expertise with a practical touch so that we can create solutions that work in the real world.

With the Wolf Theiss Dispute Resolution team you're never alone. We will accompany you throughout the litigation or arbitration, staying by your side in both national and international proceedings. We make our knowledge and industry expertise in commercial and investment arbitration work for you.

Areas of Specialisation

Commercial Litigation

We handle all types of commercial conflicts and provide representation in shareholder disputes, partnership and merger and acquisition disputes, fraud and investment scams, breach of contract and business torts, professional and product liability matters, and intellectual property right infringements. We have proven that it is possible to handle highly complex and sensitive matters in a manner that is both cost-effective and strategically advantageous for our clients.

Financial Services Litigation

We advise local and global financial players on regulatory, compliance, restructuring and insolvency matters, and represent lenders and borrowers in investigations and court proceedings. We cooperate closely with our Banking and Finance team in litigating matters on behalf of leading financial institutions and service providers, both as plaintiffs and defendants. Our litigation team routinely handles highly complex cross-border financial litigation cases.

Corporate Disputes

Whether minority shareholders or majority shareholders in small and large corporations, we pursue the interests of our clients across a range of market sectors in resolving and litigating shareholder disputes. You know as well as we that disputes involving directors and shareholders are unpredictable and have the potential to severely damage a business. Our approach is to formulate creative solutions that avoid costly court intervention. Additionally, we have wide expertise in advising companies in the area of directors' and officers' liability.

White-Collar Crime

Our white-collar crime team has international experience in representing companies and employees in criminal investigations and in conducting global asset tracing. We advise and represent clients in high-profile corruption and fraud disputes and can offer an integrated approach that saves time and money.

Compliance

Today’s highly regulated yet interlinked global marketplace requires a multijurisdictional approach to solving complex compliance problems. Our team can quickly coordinate and assess cross-border internal investigations to protect you and your business. We can also assist you in establishing corporate compliance programmes that help you identify and address your greatest risks and mitigate problems. The best conclusion to an investigation is to avoid one in the first place.

Internal Investigations

You hope it never happens, but sometimes companies find themselves faced with events that cause significant damage or some other severe impact on their business. An internal investigation might be the solution you're looking for. For many years now we have been working on matters that require in-depth internal investigations. We advise clients on investigations initiated by the government, whistle-blower complaints, dawn raids, or as a result of fraudulent activities. This puts us in the position to provide high-level service to our clients in even the most complex and sensitive of situations.

Commercial Arbitration

Our arbitration team is the largest in the region and regularly provides counsel in domestic and international arbitration proceedings. We have experience acting under the major arbitration rules, such as ICSID, UNCITRAL, ICC, LCIA, Vienna, DIS and Swiss Rules as well as in ad-hoc arbitration proceedings.

Investment Treaty Arbitration

It's a rule of thumb: the more international, the more complex. We assist clients in resolving disputes that arise under bilateral and multilateral investment treaties. Both sovereign states and claimant investors are among our clients in these complex, cross-border disputes. We also advise clients seeking to structure and restructure their overseas investments to secure investment treaty protection. Our team is particularly proficient in disputes arising under the Energy Charter Treaty (ECT).
