Real Estate & Construction
Local knowledge means everything in real estate. Our network of experts throughout the CEE/SEE region combines this knowledge with our experience with the property cycle to provide your business with advice customised for your success. From sale and purchase to planning and zoning, design, construction and development, leases, facility and asset management, finance, dispute resolution and tax, we’ve got you covered. Our whole team has hands-on experience in local markets and a track record of handling large-scale, cross-border transactions, including some of the most significant property developments in this part of the world in recent years.
The secret to avoiding lengthy and costly legal conflicts in construction is planning, and we will work with you long before the first shovel hits the dirt. If you’re planning infrastructure and construction projects such as bridges, tunnelling or other civil engineering projects, we will advise you through every stage, from contract review and negotiation until completion and the warranty phase. Our goal is to avoid problems before they become conflicts so you can do what you do best: build.
Real Estate Transactions
You can’t control risk if you don’t know how to look for it. Speed and accuracy are essential to the success of any large real estate acquisition. For your project, we will form a team of lawyers who efficiently and thoroughly assess existing legal risks and their possible impacts as well as ways to minimise them. We then present this information to you, enabling you to make a well-founded, deeply researched decision with awareness of all perceptible risks.
The old days of short, simple lease agreements are gone. Today, they are highly complex legal instruments, the drafting and understanding of which requires a thorough understanding of the business and the relevant sector. Our philosophy is simple: we want to create and negotiate successful leases for your business. This means that we take both the interests of the landlord and the tenant into account to craft a functional lease that works for all parties.
Every real estate project begins with an idea, and every idea brings with it a question or two. While you’re busy with the creative questions, let us handle the legal ones. We will advise you on purchasing or acquiring an option to purchase real estate, environmental impact assessment proceedings, planning and zoning issues, obtaining all permits necessary under public law, partitioning and joining of real estate, dealing with construction issues, architect's contracts, general planning and financing agreements.
Real Estate and Construction Finance
We make it our business to understand yours. Domestic and foreign banks as well as project development companies and their sponsors regularly turn to us for advice in real estate project financing. Our work includes financial engineering, examining the regulatory environment behind the granting or receipt of a credit or loan, as well as drafting and negotiating financing agreements and related security packages.
We know construction law, and we know how to make this knowledge work for you to keep conflicts from arising. For infrastructure and building construction projects, including tunnelling and civil engineering projects, we advise clients during the whole project; from contract review and negotiation through the completion and warranty phase.
Construction Contracts and Related Agreements
Zoning regulations, historical protection and other restrictions: every construction project carries limitations with it. But that doesn’t mean that there aren’t opportunities too. We routinely work alongside architects, engineers and surveyors to ensure that you make the most of your project while keeping relevant laws and regulations in mind. We regularly provide advice on drafting construction, general contractor and subcontractor agreements, Guaranteed Maximum Price and general planner agreements, as well as general terms and conditions for constructors and manufacturers.
You need specific legal expertise and experience for your international construction project. Many of us are FIDIC-certified Adjudicators, which means that we can represent you before courts, arbitral tribunals and dispute adjudication boards effectively and with knowledge of the process. We provide project-specific legal advice and representation on all FIDIC-based construction contracts, as well as interdisciplinary support regarding claim and contract management.
Construction Litigation and Arbitration
It's sometimes impossible to avoid lawsuits over construction projects. Claims for securing evidence, (additional) compensation, defects and damage claims, contractual penalties, disputes on geological and other risks and claims under securities: we have experience in litigating all these and more. Our knowledge of construction projects helps us to identify risks and opportunities so we can develop the litigation or arbitration strategy you need to win.
