ECHR copes with infringement of property rights in Albania

In Albania former land owners whose real propreties have been confiscated by the authorities during the communist regime, still seek remedy, either restoration of the confiscated land or compensation. An increasing number of complaints have therefore recently been filed with the European Court of Human Rights by Albanian citizens claiming that their property right was infringed by the Albanian government.  

In one such case, the European Court of Human Rights ruled that the Albanian government should undertake all legal, administrative and budgetary measures necessary to implement restitution-decisions and compensate the applicant.

With this regard, it can be noted that the Albanian Parliament recently adopted several amendments to the Law on foreign investment aiming to provide foreign investors with a special protection against damages resulting from property ownership claims and disputes.
